This website and related services are owned and operated by MULTIMEDIA DESIGN OÜ, which owns, controls, or has legal permission to license all content and materials on this website and related services, currently located at https://pincel.app (the "Site").

MULTIMEDIA DESIGN OÜ ("we", "us", "Pincel", or "our") is a limited company registered in Estonia under company number 11264311.

These Terms of Use apply to the Pincel website, web application, and mobile applications available on iOS and Android, as well as any related services provided by Pincel (collectively, the "Services").

Acceptance of Terms

By accessing or using Pincel, you agree to comply with these Terms of Use.

If you do not agree with any part of these Terms, you must not use our Services.

By using our Services, you confirm that you are legally capable of entering into these Terms.

1. Minimum Age Requirement

The Services are intended for users aged 18 years or older.

By using the Services, you represent that you meet these age requirements.

2. User Registration

To use certain features of Pincel, you may be required to create an account.

You agree to:

• provide accurate and complete information
• maintain the confidentiality of your login credentials
• accept responsibility for all activities that occur under your account

You are responsible for ensuring that your account is used only by you.

3. Use of the Services

Pincel grants you a non-exclusive, non-transferable, revocable license to use the Services for personal or commercial purposes, subject to these Terms.

You agree to use the Services only in accordance with applicable laws and these Terms.

We reserve the right to limit or restrict access to the Services if we detect misuse or behavior that may harm the platform or other users.

4. Artificial Intelligence Services

Pincel provides tools powered by artificial intelligence that allow users to generate, edit, or modify images and other media.

These features may include:

• AI photo editing
• hairstyle changes
• clothing changes
• background replacement
• image generation and enhancement
• other AI-powered transformations

By using these tools, you acknowledge that:

• outputs are generated by artificial intelligence
• results may be synthetic, approximate, or imperfect
• outputs may not always be accurate or realistic

Pincel does not guarantee the accuracy, reliability, or suitability of AI-generated content.

5. Artistic Style and Similarity Disclaimer

Artificial intelligence systems used by Pincel may generate images that resemble existing artistic styles, visual aesthetics, or publicly available imagery.

Such outputs are generated automatically based on patterns learned by artificial intelligence models and are not intended to replicate or reproduce any specific artist, photographer, brand, or copyrighted work.

Pincel does not guarantee that generated images will be unique or free from similarities to existing works.

Users are responsible for ensuring that their use of generated content complies with applicable intellectual property laws.

6. User Content and Responsibility

You retain ownership of any images or content that you upload to the Services ("User Content").

By uploading content, you represent and warrant that:

• you have the legal right to upload and use the content
• the content does not violate the rights of any third party
• the content complies with applicable laws and regulations

You are solely responsible for the content you upload and generate using the Services.

Pincel does not verify ownership of uploaded content and cannot be held responsible for misuse by users.

7. Commercial Use of Images

Unless otherwise specified, images generated or edited using Pincel may be used for personal and commercial purposes without restriction, provided that such use complies with applicable laws and these Terms.

8. Prohibited Activities

When using our Services, you agree not to:

Generate or upload content involving minors in inappropriate or illegal contexts.

Create deceptive, misleading, or harmful deepfake content intended to impersonate or misrepresent real individuals.

Upload content that violates copyright, trademark, or other intellectual property rights.

Use the Services for illegal activities or to violate any laws or regulations.

Engage in harassment, hate speech, abuse, or harmful behavior toward others.

Attempt to reverse engineer, exploit, or disrupt the Services.

Use automated tools or scripts to generate excessive requests or downloads.

Users are prohibited from excessive downloading or automating image generation. Fair usage allows a user to generate approximately one new image every 8 seconds.

We reserve the right to suspend, restrict, or terminate accounts that violate these rules.

9. System Integrity and Fair Usage

To ensure fair access and platform stability, we may implement technical limits on usage.

Accounts that abuse the system, attempt to bypass limitations, or negatively affect platform performance may be restricted or terminated.

10. AI Output Disclaimer

Images generated or edited by the Services are produced by artificial intelligence systems.

Because of the nature of AI technology:

• outputs may contain inaccuracies
• outputs may unintentionally resemble real people
• outputs may contain artifacts or unexpected results

Pincel makes no guarantees regarding the originality, legality, or suitability of generated content.

Users are responsible for reviewing and ensuring the appropriate use of any generated content.

11. Service Availability

We strive to provide reliable Services but do not guarantee that:

• the Services will always be available
• the Services will operate without interruption
• the Services will always produce the same outputs

AI technologies and underlying models may change over time.

Pincel reserves the right to modify, update, replace, or discontinue features at any time.

12. Privacy Policy

Please review our Privacy Policy to understand how we collect, use, and protect personal information.

Our Privacy Policy applies to the use of the website, web application, and mobile applications.

13. Termination

Pincel reserves the right to suspend or terminate access to the Services at any time if a user violates these Terms or engages in harmful or unlawful activity.

Termination may occur without prior notice.

14. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind.

We do not guarantee that the Services will be error-free, uninterrupted, or secure.

To the maximum extent permitted by law, Pincel disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.

15. Limitation of Liability

To the maximum extent permitted by law, Pincel shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Services.

This includes but is not limited to damages related to:

• generated content
• user-uploaded content
• loss of data
• service interruptions

16. Payment, Subscription and Billing

Payments are securely processed through Stripe, our payment processing partner.

Pincel does not store payment card information on its servers.

Users may manage subscriptions and billing through the Pincel billing dashboard.

Subscriptions may be cancelled at any time.

17. Free Trial

Pincel may offer a free trial account with a limited number of credits.

Currently, users receive 20 credits to test the platform.

No credit card is required to access the trial.

After the free credits are used, users may choose to upgrade to a paid subscription.

If you are not satisfied with the Services, you may request a refund by contacting:

Refund requests are evaluated individually.

19. Changes to the Terms

We may update these Terms periodically.

If significant changes are made, we will notify users through the website or within the Services.

Continued use of the Services after changes indicates acceptance of the updated Terms.

20. Governing Law

These Terms are governed by the laws of Estonia.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.
